In defense of the EB2I argument thought UN, I could argue that the Horizontal spillover was right all along and it was EB3ROW that benefited since 2005 at the expense of EB2I.
As you rightly point out, there is room for interpretation in the way the law is written, and that is why we keep having this discussion. I remember vehemently having this discussion with you on immigration.com. The bottom line is I am still waiting having been "current" twice since that time! The interpretation view of spillover over the last year is the only thing that gives me any hope near term.
In the mean time, those like me have dealt with a barrage of other processing changes that have affected EB2I ie Labor Subs., Eb3-EB2 jumpers, the July VB fiasco impact on older 485s etc. Not sure about the exact extent of each, but nonetheless, you feel screwed by the system when your 485 is pending for near 4 yrs.

btw; every person I know of from India who has gotten green from October 2008 were those eb3 guys who converted to eb2 through perm labor. I have a feeling that this is going to cause a lot of stress to eb2 as many people have been able to obtain old priority dates through eb3. Maybe not much solace but with perm labors taking 9 months to get approved now (most recent approvals were filed in July 2008) it does help India a bit. It is taking longer for eb2 ROW to get into 140/485 que and would cause more visas to be spilled over. If labors were getting approved fast then there would be less spillover in this fiscal year.

If you can make a concerted effort and we can ensure a large number of people will actually send the flowers, it would make a great media story. A wonderful splash on the media pages. American media will eat it up. Then get one of the IV core members to actually go on the air and explain the problem.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

Hi guys,
My first H1B (2003) had LUD on 14th of July...and today there is a LUD on I-140. My I-140 approved in March 2007..PD is March 2005...Is it good indication that they are doing something with my I-485 case? My application reached NSC on july 2nd (not sure about time as my lawyer sent those papers). My I-140 is from TSC.
Mine is pretty much the same situation and see a LUD of 08/05/2007 on my I-140 today. Hopefully I will see checks cashed in the next couple of days. Fingers crossed. :confused:

Who said ? Lawsuits will not work. If you guys have any doubts ? Follow the links below, iam gonna paste. It will tell you how powerful lawsuits are in this country if you think you have been fooled over and over on false promises. This is especially true in the case of People whose priority date was current for a long time but still they were made to wait because of unknown reasons by USCIS while the folks who had priority dates as recent as 2006 walked with Green Cards. People especially who fall under this category are sure to succeed only by filing lawsuits. I dont see any other way out here.

Mine is Eb 3..was sent to Nebraska, got there July 2, signed by R. Michaels at 9 am...Transfered to Texas,Received July 6...They sent me the Notice of Action for my 140 but I don't know anything else and I also sent at the same time 485-765 for my whole family...

If you really wanted to correct the so called misinformation I am spreading why do you have to start with things like "IV member know that you don't want to volunteer"? Is this is supposed to intimidate me or you just trying to spin information for your own cause?
Please understand that I am not against what IV stands for and what the members do. What I don't agree with is the way some immature Senior members do by loosing their cool. Cutting off peoples thoughts and ideas in not right. I would go futher to make a bold suggestion, " IV has to screen these so called senior members for maturity before making them members who carry the message"
I am not blaming anyone here, but moderation in their temper is expected off the senior members in any place not just in this forum. Intimedation and threats have always resulted in the downfall of the whole group, history would teach us that.

No wonder you are disconnected from reality about how far IV has come. It is a fact and all members know this, IV scooped the July visa reversal.
Please stop living in the blunderland and face the reality. IV was a big reason, we never clam to be the sole reason. We work with other stakeholders. Without a grassroot effort none of the other constituents would have been effective. You mention about the AILA lawsuit "threat," well, why didn't they actually file the lawsuit? We agree that the lawmaker's letter was instrumental in the July visa fiasco reversal. We had an unprecedented San Jose rally by legal immigrants. You need to get serious and need to contact your state chapter leader to get some more information about IV.

When you think about it, reservation and quota system is actually a better deal for the upper caste.
First check out this picture, which details the population percentages and proposed reservations: File:PopulationEstimations.jpg - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/File:PopulationEstimations.jpg)
As per the above picture, 52% of people in India belongs to Backward classes according to Mandal estimates. Since the proposed reservation for them is 27%, the reservation system works in favor of Forward classes as long as Backward classes are not uplifted from their current pathetic situation. Another way of looking at the graph is that 25.5% of people in India belongs to forward classes; and their share in the Indian pie in terms of higher education of job opportunities --> (100 - 27 - 22.5 = 50.5%). Personally I like this system, than 25.5% of us getting only 25.5% of our share.
To conclude:
If reservations stays; 25% upper caste can enjoy 50% of resources.
If reservation system goes away due to uplifting of backward classes; 25% of upper caste will have to satisfy themselves with only 25% of resources.

Your posting is quite realistic. Miracle will not happen, regardless how much we want it. Sad but true.
The only (long but possible) way to achieve some results is massive attack of the media. Average American people should realize the problem of the legal immigrants and THEY should start pressing the lawmakers for resolution. In fact there is a very simple solution - every H1/L1 visa should be covered by a GC option, providing that the immigrant has covered all requirements. And the USCIS administration should be pushed to do their job. Now, cunningly, uncle Sam (I would better say the "Edited" people) allows white collar slaves to come to the US, but hides the GC when time comes.
To be honest, I really believe that in 10-15 years time this problem will not exist anymore. Reasons? Several: First, the main donoring countries of white collar slaves are in process of sharp development and soon this source of "blood transfusion" to US will start drying up. Second, with the aging baby-boomers the need of "blood transfusion" will increase. Third, the high flow of low qualified legal/illegal Latinos changes the fabric of the American society and turns it into a Latin-American country, with all negative consequences, so the need of high tech immigrant component will increase. There are more factors but these three are enough.
So, if we are patient, in 10-15 years time the USCIS administration will start sending invitation ads all over the world, inviting legals and we would become proud holders of GCs :-)
